Some definitions of the words we use: 

Agent: Scuba Circle will act as the agent on behalf of the operator, thereby offering marketing and reservation services to the operator.
Force Majeure Event: An event that is beyond the control of the operator or the agent, such as natural disasters, political unrest, criminal attacks, etc.
Guest: The people going on a trip offered by the operator, including if applicable the person that is making the reservation.
Operator: The entity that offers scuba diving day trips, liveaboard trips/cruises or other products offered through the agent. The operator receives the guests and the money for services rendered as agreed between Agent and Operator.
Price: The amount of money shown to the guest on the website when making a reservation.
Product: A diving trip or a liveaboard trip including all features that are stated as included by the operator or in the package customised by the Agent.
Reservation: Agreements between guests and operators. Scuba Circle facilitates this agreement and hold no responsibility for the product supplied by the operator to the guest.
Website: The website www.scubacircle.com including all pages. Mobile or tablet versions of the website are also included in the definition of website..

  1. Reservations
    • Scuba Circle provides a service as intermediary agent. The reservation forms an agreement between the guests and the operator. Scuba Circle is not a party in this agreement and is only responsible to lead the trip to ensure a smooth experience.
    • Reservations are made online through the website of Scuba Circle and are subject to the availability of the requested product of the operator.
    • Scuba Circle is responsible for correct execution of the reservation process, but not for the product supplied by the operator.
    • In some cases extra information (for example, but not limited to passport copies, evidence of guest insurance, health certificates, flight details, etc.) is needed by Scuba Circle to make a reservation complete. We hold the right to cancel the reservation according to the applicable booking policy for the particular booking in case this information is not supplied by the guest.
    • We will do our utmost to help customers in need of assistance whilst on their trip and those stranded in bad situations, but we are at no time to be held responsible for such situations.
  2. Responsibility of the guest
    • Customers are themselves responsible for transportation to and from the location of the beginning of the trip. Scuba Circle may offer some suggestion for airlines, hotels and transfer option, but holds no affiliation with these companies and thus cannot be held accountable for their services.
    • Customers are responsible to meet the health and disability requirements defined by the operator, and make sure they are in good shape by conducting a health check-up by a healthcare professional if they book a diving trip. Customers must notify us in writing at the time of booking of any physical or mental illness, disability or other conditions for which special accommodations or the use of a wheelchair is necessary or contemplated.
    • To participate in diving activities requires certification by organizations such as PADI or SSI to make sure you have all necessary skills for safety and enjoyment during a diving trip. The customers themselves are responsible to meet the minimum required logged dives standard of each diving trip. Guests are responsible to get relevant and appropriate training before going on any trip.
    • Customers should take care of their own insurance, ensuring it covers adventure travel and sports (for example insurance provided by DAN network or World Nomads) so as to be protected in case of dive accidents or other adventure-travel related risks.
    • The customer agrees to respect to rules of the operator and acknowledges that if the rules of the boat are broken, the operator (or captain) has the right to deny entry on board, deny diving activities or any of the activities offered by the operator.
    • The customers themselves are responsible to meet the passport, visa, health requirements to enter the country or countries where the trip is organized.
    • We advise guests to review travel prohibitions, warnings, announcements and advisories issued by their governments prior to their departure.
    • The guest should inquire about vaccination and prevention of tropical ailments with a doctor and follow their advice. Scuba Circle cannot provide medical advice.
    • If for any reason you are delayed in transit and fail to reach the destination as per the schedule, Scuba Circle will not be responsible for any loss of costs involved services not rendered due to delay in arrival. Scuba Circle will do their best to adjust the itinerary concerned, but does not guarantee it. This is a group booking for multiple passengers and we will do our best to ensure all fairness is accorded to the entire group. As a courtesy to participants and Scuba Circle cannot be held responsible for any additional costs occurred due to changes for bookings not done by Scuba Circle or Operator. In case of a liveaboard trip, we advise you to travel at least a day early and have an extra day on land before the day of the return flight to ensure you do not miss the departure date of the boat.
  1. Special requests
    • During reservation the guest can make special requests. These requests may need additional information and will be agreed upon in communication between the operator and the guest. Scuba Circle is in no situation responsible for the availability or condition of rental gear, special dietary requests, specific extra accommodation facilities, (dive) courses requested, activities requested and other special requests.
    • For diving gear, we advise guests to bring their own gear as this will contribute to a better diving experience. We do advise guests to rent an additional diving computer in case one breaks down, to prevent not being able to dive for 24 hours.
    • Special dietary requests may be notified. We do advise however to limit these requests to necessary diet requirements only (e.g. due to religious beliefs or allergies). We do however suggest that our guests enjoy the delicious food served by most operators.
    • For airports pickup please contact the operator to confirm flight number, arrival time and meeting point. Scuba Circle does not take responsibility for airport transfers, unless included in the package.
  1. Payments
    • Bookings are only valid when a deposit payment is received.
      • 50% Advance (Unless specified otherwise)
      • Balance payment: required at least 30 days prior to travel date.
    • Payment Methods:
      • By Bank Transfer: all charges are on sender’s account
      • By Credit Card: a convenient fee surcharge of 3% is applied for Visa/Master cards and 4% for AMEX cards (Please ask us to generate a payment link)
      • Cash (US dollars. Other currencies may be accepted by prior arrangement)
    • After payment has been received we will send a form to you via email or WhatsApp. Once the form has been completed we will email you a Booking Voucher which serves both as proof of your booking and as an invoice. Please bring a copy (digital or physical) with you and also keep a copy for future reference.
    • Scuba Circle reserves the right to charge the costs incurred for payments that are not performed correctly (such as credit card chargebacks and or non-OUR bank transfers).
    • Scuba Circle relies on our partners, such as Instamojo and Razorpay for online payments and transactional services. Scuba Circle cannot be held responsible for their services.
    • Full amount is due on date of reservation or as specified. If you want to pay a lesser deposit than demanded you can do so by stating this as a special request during booking and select bank transfer payment. We do have to charge an extra fee for the extra bank and administration cost we endure.
    • All our rates are charged in INR or USD. Quotations in other currencies are for reference only.
  1. Cancellation & Amendments
    • Different cancellation policies may apply to each reservation and for each reservation the guest needs to agree with the specific booking conditions provided by the operator. At Scuba Circle we do our best to minimize cancellation penalty for our guests but we must abide by the cancellation policy of each service provider. Below are general cancellation policies:
      • Cancellation 60 to 90 days before departure date:
        charge 10% of total amount.
      • Cancellation 45 to 60 days before departure date:
        charge 30% of total amount.
      • Cancellation 30 to 45 days before departure date:
        charge 50% of total amount.
      • Cancellation less than 30 days before departure date:
        charge 100% of total amount.
      • No show: 100% of total amount.
    • Please Note: If you wish to transfer your spot to another Diver, there will be a processing charge of 5% applicable also is subject to our approval. There may be additional charges in case any non cancellable or non transferrable bookings have been made on your behalf such as tickets.
    • No show for or early departure from a trip is considered to be the same as a cancellation after departure and no refund applies.
    • In case of a booking amendment request we will do our best to help you as a guest to find a suitable alternative trip depending on availability of operators and trips.
    • In case of amendment or cancellation with a (partial) refund we will apply a 5% administration fee to cover our credit card, bank transfer and/or handling costs incurred, in addition to the cancellation policy as described under 5.1. This fee is calculated on the total amount of the reservation. Cancellations always need to be submitted in writing by email (dive@scubacircle.com) to avoid misunderstanding.
    • Liveaboard Operators depends on maintenance schedules (dry-dock) in their operating country. If the vessel is not in condition to sail or if there are any delays in the dry-dock, the liveaboard operator has the right to operate the same itinerary with a different vessel. In this case the customers have to accept the change of vessel. If the standard of the vessel lacks important facilities compensation can be made, but this is not an obligation.
    • The operator has the right to replace the vessel and operate the same itinerary as long as the vessel offers similar standards as the liveaboard or cruise boat that was initially booked by the guest. Scuba Circle will not be liable for disputes arising out of the appointment of a different vessel.
    • The operator has the right to change the accommodation depending on availability and the condition of the same for use.
    • The operator has the right to change the dive sites and locations depending upon the weather and keeping in mind the safety of the guests.
    • In line with the industry norm, trips cancelled by the operator entitle you to a refund. Shortened trips entitle you to a proportionate refund, delayed trips to a choice of refund or re-scheduled trip, and lengthened trips have no extra charge. Scuba Circle will not be held responsible for any loss from other expenses incurred by Guest.
  1. Liability
    • The reservation forms an agreement between the guest(s) and the operator. Scuba Circle only serves as an intermediary and therefore cannot be held responsible for possible shortcomings in the operators’ performance. While Scuba Circle does their best to ensure only quality checked operators are used.
    • The guest agrees to never in any case hold Scuba Circle responsible for unforeseen circumstances. Liability waiver may need to be signed or entrance on the ship in case of liveaboard or day trip diving may be refused by the operator.
    • Scuba Circle cannot be held responsible for delays of flights and or transfer companies. Scuba Circle cannot be held accountable for wrong information published on partner websites.
    • Neither Scuba Circle, nor the operator, will be responsible for any losses you suffer (including for example any missed flights) due to failure to allow sufficient time for your journey.
    • Scuba Circle or its agents, founders, promoters, affiliates, group leaders or instructors cannot be held liable for and will not be responsible for personal injuries, property damage, or wrongful death that may occur during activities, as a result of the inherent risks associated with scuba diving, or any activity offered by the operator or as a result of acts or omissions of other third parties.
    • Scuba Circle cannot be held liable for changes in dive sites by the operator, changes in accommodation or any other changes by the operator.
    • We reserve the right to amend reservations in case this is deemed necessary. This applies to the itinerary, the operator and the accommodation. As long as the proposed alternative by Scuba Circle is of similar value the reservation, considered to be valid and thus Scuba Circle will not be liable for any disputes arising from the change.
    • In case Scuba Circle is held responsible for mistakes in the reservation services provided, the maximum liability shall not exceed any profit made for the service provided by Scuba Circle.
    • Furthermore, Scuba Circle and/or your operator are not responsible and cannot be held liable for delays, changes or cancellation of service when the product cannot be executed partly or wholly owing to acts of god, political unrest as well as military or civil conflicts and terrorist activities, ‘force majeure’, or due to other circumstances that are unforeseeable or beyond the operator’s’ control.
  1. Complaints & disputes
    • Since Scuba Circle only acts as the agent, Scuba Circle cannot be held responsible for the quality of the service provided by the operators. In case the guest is dissatisfied with the service provided, the guest should step up to the Operator Manager, Owner or our Trip Leader immediately to communicate the complaint or immediately email our founder at ankush@scubacircle.com or WhatsApp at +91 97111 33124
    • We will do our best to channel complaints made after return into a constructive feedback for the operators to improve their services.
    • In general the law of the country in which the transportation took place will apply to the relationship between the guest and the operator. Disputes between you as guest and the operator will generally have to be settled by the court of the country in which the trip provided by the operator took place.
    • Scuba Circle may help you to file a complaint if you tell us as fast as possible about your issue and provide a factual record of the complaint with details of what happened, when and with whom. In the event that you are entitled to and receive a refund after your vacation, there will be a 10% administration fee deducted from such refund, to cover our own operational costs.
    • If the complaint is about the service provided by Scuba Circle (involving the website, payment collection and travel consultation), please submit your complaints through our contact form. We will do our very best to follow-up and help you, as your satisfaction is our top priority.
    • The original English version of these Terms of Use may have been translated into other languages. In the event of a dispute about the contents or interpretation of these Terms of Use or discrepancy between the English version and any other language, the English language version to the extent permitted by law shall apply. The English version is available on our website (by selecting the English language).
  1. Miscellaneous
    • We take pride in protecting your personal information. Our policy regarding your privacy and how we use cookies on this website is outlined in our Privacy Policy.
    • All information on our website is provided in good faith and is believed to be correct at the time of publication. Scuba Circle will not be held responsible for any inaccuracies due to ‘out of date’ information provided to us by the operators.
    • By submitting a review you grant Scuba Circle the full, transferable and irrevocable rights to it, including your name. Scuba Circle may use, translate, edit, reproduce, refuse or remove reviews at its sole discretion.
    • All of the information on this website is protected by copyright and cannot be duplicated, copied or used for any commercial purpose within the explicit and written consent of Scuba Circle.
    • You are not allowed to re-sell, deep-link, use, copy, spider or scrape, display, download or reproduce any content or information, software, products or services available on our website for any commercial or competitive activity or purpose. Our services are made available for personal and non-commercial use only.
    • Safety standards and regulations conform to local standards and could be more or less stringent than in your home country. The monitoring and enforcement of those regulations is a matter for the authorities in that country and the local operator concerned.
    • Scuba Circle reserves the right to possible adjustments of prices and conditions.
    • These Terms of Use shall be governed by Indian law and any dispute arising out of these Terms of Use and our services shall exclusively be submitted to the competent courts in New Delhi, India.If any provision of these terms and conditions is or becomes invalid, you shall remain bound by all other provisions hereof.
